Pleadings decide the case
The issues framed by a civil court flow from the pleadings. If a plea is not taken, evidence on that point may not be looked at. Time spent at the drafting stage — setting out dates, documents and the relief sought precisely — is therefore not preparatory work but the case itself.
Interim protection
Where property or a right is at risk of being altered during the pendency of a suit, interim applications for injunction or for maintenance of status quo may be moved. Such relief is discretionary and is decided on the material placed before the court.
