Who may claim
Depending on the applicable law, maintenance may be claimed by a spouse who is unable to maintain herself or himself, by children, and by parents in defined circumstances. Both interim maintenance during pendency and final maintenance may be considered.
What is generally examined
- Income and earning capacity of the person from whom maintenance is claimed
- Reasonable needs of the claimant, including residence, education and medical expenses
- Standard of living during the period of cohabitation
- Other dependants and existing liabilities
Enforcement
An order for maintenance that is not complied with can be enforced through the procedure available in law. Records of payments made or not made should therefore be kept carefully by both sides.
