What Is a Property Dispute?

Before asking what remedy is available, it is worth asking precisely what is in dispute. The answer decides the forum.

People describe very different problems as a 'property dispute'. Sorting them into categories is the first useful step, because each category has its own remedy and forum.

Disputes about ownership

Here the question is who holds title. Such matters usually require the chain of documents, the manner in which the property devolved, and the position of possession over time.

Disputes about possession

A person may hold title yet be out of possession, or hold possession without a clear document. Possession disputes, including encroachment on boundaries, are treated differently from title disputes.

Disputes among co-sharers

Where several heirs or co-sharers hold jointly, the dispute is often about shares and division rather than ownership as such. Partition, by agreement or by proceeding, is the usual route.

Disputes about the record

Where the grievance is an entry in a revenue record, or a mutation not carried out, the proceeding generally lies before the revenue authorities rather than the civil court.

Disputes about a document

Where a sale deed, gift deed or power of attorney is alleged to be invalid, the challenge is to the document itself, and the relief sought must be framed accordingly.
